You are solely responsible for the content you create and share on the Service. 8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. WE MAKE NO WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

These Terms shall be governed by and construed in accordance with the laws of Queensland, Australia, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right to modify or update these Terms at any time without prior notice. Your continued use of the Service after any such changes shall constitute your acceptance of the revised Terms.

1. Availability of the Service

FactEngine offers the online service subject to availability. An availability of 100 percent is technically not feasible and can therefore not be guaranteed to the customer. However, FactEngine endeavours to keep the service available as constantly as possible. In particular, maintenance, security or capacity concerns as well as events that are not within our sphere of control (disruptions of public communication networks, power failures, etc.) can lead to disruptions or the temporary shutdown of the service.

FactEngine will inform the customer in advance of any planned maintenance as far as possible via e-mail. In order to maintain availability, integrity and resilience of the systems, networks, programs, applications and data supporting the service, FactEngine may switch off or modify programs, applications, scripts, apps, files and links in whole or in part, including the provision of updates, upgrades or the providing a new version, insofar as this is in the interests of customers, other customers and FactEngine.
